Article 1. Applicability

1.1 All offers, orders and agreements of Drogisterijplus.nl are subject to these General Terms and Conditions.

1.2 Accepting an offer or placing an order implies that you accept the applicability of these Terms and Conditions.

1.3 The provisions of these Conditions may be departed from only in writing, in which case the remaining provisions shall remain in full force and effect.

1.4 Alle rechten en aanspraken, zoals in deze Voorwaarden en in eventuele nadere overeenkomsten ten behoeve van Drogisterijplus.nl worden bedongen, worden evenzeer bedongen ten behoeve van door Drogisterijplus.nl ingeschakelde tussenpersonen en andere derden.

Article 2. Offers/Agreements

2.1 All offers from Drogisterijplus.nl are without obligation and Drogisterijplus.nl expressly reserves the right to change prices, especially when this is necessary under (legal) regulations. See also article 3.6.

2.2 An agreement only comes into effect after acceptance of your order by Drogisterijplus.nl. Drogisterijplus.nl is entitled to refuse orders or attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Drogisterijplus.nl will communicate this within ten (10) working days after receipt of the order.

Article 3. Prices and payments

3.1 The prices stated for the products and services offered are in Euros or if chosen on the website in Dollars, including VAT and excluding handling and shipping costs, any taxes or other charges, unless otherwise stated or agreed upon in writing.

3.2 Payment shall be made without discount or compensation within fourteen (14) days after the invoice date in the case of deliveries within the Netherlands, and within twenty-one (21) days after the invoice date in the case of deliveries outside the Netherlands, unless otherwise agreed in writing.

3.3 Payment can be done by payment method as indicated on the shopping cart page. When paying by bank or giro, the date of payment is the date of crediting the giro or bank account of Drogisterijplus.nl.

3.4 If the term of payment is exceeded, you are in default from the day on which payment should have taken place and, from that day, you owe default interest of 1% per month or part of a month over the outstanding amount. If payment takes place after reminder by Drogisterijplus.nl you owe an amount of twenty-five Euros (� 25,00) for administration costs and if Drogisterijplus.nl outsources its claim for collection, you also owe the collection costs, which are at least fifteen percent (15%) of the outstanding amount, without prejudice to the authority of Drogisterijplus.nl to instead claim the actual extrajudicial collection costs incurred.

3.5 If you default on any payment, Drogisterijplus.nl is entitled to suspend or dissolve (the execution of) the relevant agreement and related agreements.

3.6 If the prices for the products and services offered increase in the period between the order and its implementation, you are entitled to cancel the order or dissolve the agreement within ten (10) days after notification of the price increase by Drogisterijplus.nl.

3.7 To fulfill the orders Drogisterijplus.nl accepts two payment options. These are IDEAL and Paypal payment system.

Article 4. Delivery

4.1 The delivery times given by Drogisterijplus.nl are only indicative. Failure to meet any delivery deadline does not entitle you to compensation or the right to cancel your order or dissolve the agreement, unless the failure to meet the delivery deadline is such that you cannot reasonably be required to maintain the agreement. You are in that case entitled to cancel the order or dissolve the agreement to the extent necessary.

4.2 Delivery of the products will be made at the place and time when the products are ready for shipment to you.

Article 5. Retention of title

5.1 Ownership of delivered products is not transferred until you have paid all that you owe under any agreement to Drogisterijplus.nl. The risk regarding the products is already transferred to you at the time of delivery.

Article 6. Intellectual and industriële eigendomsrechten

6.1 You must respect all intellectual and industrial property rights that rest on the products supplied by Drogisterijplus.nl completely and unconditionally.

6.2 Drogisterijplus.nl does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

Article 7. Complaints and liability

7.1 You have the obligation to examine upon delivery whether the products meet the agreement. If this is not the case, you must inform Drogisterijplus.nl as soon as possible and in any case within fourteen (14) working days after delivery, at least after observation was reasonably possible, in writing/email and stating reasons.

7.2 If it is demonstrated that the products do not meet the agreement, Drogisterijplus.nl has the choice of replacing the products in question with new products upon return or refunding the invoice value thereof.

7.3 If for any reason you do not wish to purchase a product, you have the right to return the product within fourteen (14) working days after delivery to Drogisterijplus.nl. Returns in this case are only accepted if the packaging of the product is undamaged, whereby also applies that the costs for returns will be at your expense.

Article 8. Warranty

8.1 If Drogisterijplus.nl supplies products to the client, Drogisterijplus.nl is never obliged to a further guarantee towards the client than on which Drogisterijplus.nl can lay claim towards its supplier. The warranty period will always be clearly stated on the invoice.
Reclamaties wegens uiterlijk waarneembare gebreken moeten conform de contractvoorwaarden, doch uiterlijk binnen viertien (14) dagen na ontvangst van de goederen door de opdrachtgever schriftelijk worden ingediend.

Article 9. Orders/Communications.

9.1 Drogisterijplus.nl is not liable for misunderstandings, mutilation, delays or improper transmission of orders and messages as a result of the use of the Internet or any other means of communication in the traffic between you and Drogisterijplus.nl, or between Drogisterijplus.nl and third parties, insofar as these relate to the relationship between you and Drogisterijplus.nl, unless and insofar as there has been intent or gross negligence on the part of Drogisterijplus.nl.

Article 10. Force Majeure

10.1 Without prejudice to its other rights, Drogisterijplus.nl has the right, in case of force majeure, at its option, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, by informing you of this in writing and without Drogisterijplus.nl being obliged to pay any compensation, unless this would be unacceptable under the given circumstances according to standards of reasonableness and fairness.

10.2 Force majeure is defined as any failure which cannot be attributed to Drogisterijplus.nl, because it is not due to its fault and neither under the law, legal act or generally accepted for its account.

Article 11. Miscellaneous

11.1 If you provide an address in writing to Drogisterijplus.nl, Drogisterijplus.nl is entitled to send all orders to that address, unless you provide in writing to Drogisterijplus.nl another address to which your orders should be sent.

11.2 When Drogisterijplus.nl allows deviations from these Terms and Conditions, whether tacit or not, for a short or longer period of time, this does not affect its right to demand direct and strict compliance with these Terms and Conditions. You can never assert any rights based on the fact that Drogisterijplus.nl applies these Terms and Conditions leniently.

11.3 If one or more of the provisions of these Terms and Conditions or any other agreement with Drogisterijplus.nl should be in conflict with any applicable legal requirement, the provision in question will lapse and will be replaced by a new legally permissible similar provision determined by Drogisterijplus.nl.

11.4 Drogisterijplus.nl is authorized to use third parties in the execution of your order(s).

Article 12. Applicable law and competent court

12.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law.

12.2 All disputes between the parties shall be submitted exclusively to the appropriate court in the Netherlands.
